Starting position
When is ongoing marketing compliance worthwhile?
When the same risks recur in new forms and cost time and approval certainty.
The real risks arise at the interfaces between marketing, product, data protection, sales and external parties.
Landing pages, ads, newsletters, teasers and creator formats are produced in parallel. Your team needs review paths that show when a measure is routine and when it requires a deeper review.
Claims, consent, tracking, marketing to existing customers and performance promises interact. Ongoing support achieves more here than an isolated approval shortly before publication.
Agencies, creators and service providers are involved. Briefings, chains of rights, paid usage and labelling must work across several parties.
In-house legal or management want to avoid repetition. Structured marketing compliance is then more economical than a series of separate individual reviews.

Good support makes teams clearer rather than more cautious. It creates fewer hectic loops, fewer vague risks and more certainty about when a measure can go live immediately.
We rarely see campaigns fail because of complicated legal problems. We see them fail because of disorganised approvals, scattered evidence and unclear asset rights.
Many teams treat compliance as the final checkpoint before publication. It is more economical to structure roles, approvals, evidence, data flows and asset rights early.

Process
How does the advice work?
In three steps from the enquiry to a robust approval.
01
Send enquiry You describe campaign, channel, schedule and question. You can send drafts and briefings straight away.
02
Classify the risk We review claims, mechanics, data and rights and give a clear recommendation with suggested changes.
03
Steer approvals On request, we build roles, review levels and templates for recurring cases with your team.
How robust approvals come about
- 1
Separate standard from special cases Routine cases run through clear review rules. We review cases with a high claim level, data relevance or conflict potential more closely.
- 2
Clarify responsibilities in practice Who may approve? When is a review in marketing enough, and when must in-house legal, data protection or management be involved?
- 3
Document evidence We record the basis on which approval was given and whether rights of use, editing, paid usage and reuse have been clarified.
- 4
Consider data flows early We review newsletters, consent, tracking, CRM and audience uploads together with the campaign, not only at the end.
- 5
Define the response in advance We define response paths in advance for attacks on claims, cease-and-desist letters, platform problems or public criticism.
How long does it take? We complete most work steps within a few working days. How quickly it goes depends on the scope and your feedback. Do you have a fixed date, such as a launch? Tell us right away in your enquiry and we will plan for it.

Risk points
Which weaknesses become expensive day to day?
Big problems grow from small ambiguities.
Approvals depend on individual people instead of robust routines.
Claims are condensed internally without the evidence and approval basis moving with them.
Marketing, product and data protection do not review on the same basis.
Agency, creator and template material is reused without checking the scope and duration of the rights.
Newsletters, tracking and audience building work technically but are not consistent organisationally.
Teams do not distinguish between standard case, special approval and genuine escalation.
Specialist pages
When does a specialist area fit better?
If a question becomes narrow in substance, the path leads to an in-depth review.
For labelling, price advertising, comparative advertising, discount campaigns or individual claims.
For efficacy promises, sustainability claims and technical product features.
For cease-and-desist letters, injunction demands, contractual penalties and court escalation.
For platform rules, creator briefings, labelling in short formats and whitelisting.
For legal bases, service provider roles, audience uploads and marketing to existing customers.
For the basics of the area of law and the bigger picture.
Legal framework
Which rules apply to campaigns?
Misleading advertising claims are prohibited under Section 5 UWG. Anyone who makes a claim should be able to substantiate it.
Under Section 5a(4) UWG and Section 6 DDG, commercial communication must be recognisable as such. This affects creator posts and collaborations.
Email advertising requires prior express consent under Section 7(2) no. 2 UWG. Section 7(3) UWG allows an exception for existing customers under narrow conditions.
Section 25 TDDDG applies to tracking and cookies. Processing personal data for advertising requires a legal basis under Art. 6 GDPR.
For price reductions, Section 11 PAngV requires stating the lowest price of the last 30 days.
- Section 5 UWG Misleading commercial practices.
- Section 5a UWG Misleading by omission and labelling of commercial communication.
- Section 7 UWG Unreasonable nuisance.
- Section 6 DDG Commercial communication.
- Section 25 TDDDG Terminal equipment and cookies.
- Section 11 PAngV Price reductions.
- DSK guidance on direct marketing Data processing for advertising purposes.
Limits
Where are the limits of the advice?
Clear boundaries keep advice and disputes apart.
- 1
No defence in the package We handle cease-and-desist letters and actions as a separate mandate.
- 2
No promise of outcome We reduce risks. Whether a claim holds up in a dispute is ultimately decided by the court.
- 3
Evidence comes from you You provide studies, tests and product data for advertising claims.
- 4
The decision remains yours We recommend. You decide on go-live and changes.
How to recognise a strong set-up
- Clear review levels for routine cases and sensitive measures.
- Documented responsibilities between marketing, in-house legal, data protection and management.
- A verified chain of rights for images, videos, music, texts and creator material.
- A defined response path for attacks on claims, cease-and-desist letters or platform pressure.

FAQ
What do teams ask about marketing compliance?
Do we need ongoing support or individual reviews?
For an urgent campaign, a targeted review with a clear decision is enough. If the same questions come up regularly, an ongoing review structure is more economical.
Do you work with our agency?
Yes. If you wish, we align briefings, approvals and chains of rights with agencies and creators.
Do you also review newsletters and tracking?
Yes. We review consent, marketing to existing customers, cookies and audience uploads together with the campaign.
How quickly do we get an approval?
We get back to you on working days within 24 hours. We align the review schedule with your planned launch.
What happens with a cease-and-desist letter?
Then it is about deadlines, the cease-and-desist declaration and defence. On request, we handle this as a separate competition law mandate.
Do you also train our team?
Yes. On request, workshops and playbooks for approvals, labelling and escalation are part of the package.
Next step
Should your next campaign be reviewed?
The earlier roles, evidence and data flows are clarified, the calmer marketing operations remain.
