Proceedings in Hamburg
Proceedings before the Hamburg Regional Court
In Hamburg, ITMR Rechtsanwälte acts in press law and competition law, among other areas. At the Hamburg Regional Court (Landgericht), press and speech matters are heard by the press chamber, and competition matters under the UWG (Act against Unfair Competition) by the chambers for commercial matters. Whether an application can be filed in Hamburg depends on the place of jurisdiction – and that follows different rules in press law and in competition law.
Forum shopping (“flying jurisdiction”)
Under Section 32 ZPO (German Code of Civil Procedure), actions in tort fall within the jurisdiction of the court in whose district the act was committed. If several courts are available, the claimant may choose under Section 35 ZPO. This combination produces what is known in practice as the “flying” place of jurisdiction. Mere technical accessibility is not sufficient; what counts is intended distribution.

For claims arising from publications, the right to choose under Sections 32 and 35 ZPO remains; since 1 January 2026, the Regional Court has jurisdiction under Section 71(2) No. 7 GVG regardless of the amount in dispute. In March 2026, the Hanseatic Higher Regional Court held that, for infringements of personality rights on the internet, local jurisdiction is generally limited to the place where the content is actually likely to be noticed. According to this, a nationwide place of jurisdiction only exists if the publication has no local or regional connection.
Advice on press lawCompetition law (UWG)
Since 2 December 2020, Section 14(2) sentence 3 No. 1 UWG has excluded jurisdiction at the place of the act for infringements in digital services. The Higher Regional Courts assess the scope of this exception differently. The Hamburg Higher Regional Court limits it to cases with a risk of mass enforcement; Frankfurt am Main and Cologne limit it to information and labelling obligations, while Koblenz interprets it close to the wording.
Advice on competition lawUrgent proceedings & preliminary injunctions
In the case of an unlawful statement or a competition infringement, a preliminary injunction may be considered if the matter is urgent. So tell us when you learned of the publication or the infringement. Urgent proceedings end at the Higher Regional Court.
Preliminary injunctionCounterstatement
A statement of fact in a publication may give rise to a claim to publish a counterstatement. We review the statement of fact, the form and the deadline for the counterstatement request.
Advice on press lawMain proceedings
After a preliminary injunction, the final letter, main proceedings, settlement and decision on costs determine whether the case is closed. You can also pursue the claim directly in main proceedings without urgent proceedings.
Advice on competition lawWhy the choice of court matters: choosing the wrong court does not extinguish the claim. On application, the case is referred to the competent court under Section 281 ZPO; the applicant bears the additional costs, and in urgent proceedings the detour can jeopardise urgency. For details, see our article (in German) Fliegender Gerichtsstand in Veröffentlichungssachen.
